The article analyses legal status of the state and municipal customer as the required subject of relations for placement of orders for the state and municipal needs.. Customer appears as the required subject of relations for placement of orders; he is entitled by the legal entity with the right to spend budget funds and resources, obtained from the activity giving income, and bears responsibilities to the bidders during the bidding process. The legal entity undertakes financial obligations to the supplier, executor, contractor only after making a contract and does not possess any rights and does not bear responsibilities in the process of orders placement for the state or municipal needs.
