OBTAINING OF THE PRIVATE PROPERTY RIGHT FOR THE GARDEN LAND PLOTS: THE BASES AND PRACTICE OF THEIR APPLICATION

The present article contains the review of the bases for obtaining the private property right by citizens and the gardening associations; the author has reviewed the legal possibilities and practical problems of implementation of the order of acquisition of the garden land plots for private ownership. Features of such bases of acquisition of the land plots as the decision of state authorities and local self-governments, direct instructions of the law, the court enactment, transaction have been analyzed. Specificity of the content of the agreement of purchasing and selling and implementation of the succession rights for the land plot have been revealed. The author has given great attention to the analysis law implementation practice and especially to the practical problems connected with the claim about recognition of the property right to the land plot.
