The issues of correlation of principles of inevitability and severity of punishment are examined in the article in criminological aspects based on analysis of the essence of mechanism of the criminal-legal effect, public opinion and position of domestic legislator. The historical experience of implementing principles of criminal legislation is examined; the current notions of citizens and lawmakers about severity and inevitability of punishment are analyzed. Conclusions about necessity of keeping severity of punishment while applying the criminal sanctions is made, as well as about mandatory prioritizing the principle of punishment inevitability in practical application. The necessity of legislative recognition of the principle of punishment inevitability is underlined. |
