«CIVIL CIRCULATION»: APPROACHES TO UNDERSTANDING AND THEIR INTERPRETATION IN THE RUSSIAN CIVIL LAW

The article systemizes approaches to understanding of the civil circulation that have been developed in the Russian doctrine. The conventional nature of opposition of the individual approaches is illustrated; the normativism inherent to the modern researches of the category under consideration is underlined. Particular attention is paid to the position about «broad» and «narrow» understanding of the civil circulation, on which analysis the thesis about absence of the universal and accepted definition of the civil circulation, as well as the uniform interpretation of existing approaches to its understanding is justified. The conclusion is made that the promising direction of further cognition of the civil circulation is critical interpretation of the developed postulates related to his understanding, which, in its turn, requires modification of the used methodology of research of civil circulation, namely, application of a systematic approach.
