IMPROVING THE LEGAL REGULATION OF THE ISSUE OF PREPAID CARDS IN THE RUSSIAN FEDERATION

This article addresses the problem of the imperfection of the electronic payment system of Russia in terms of issuing prepaid cards. The relevance of the topic is the need to improve the legal mechanisms designed to ensure stable and progressive development of the Russian economy. Also, the relevance is due to the need to improve the legal mechanism for countering crimes committed with the use of prepaid cards of electronic payment systems. Based on the analysis, the legal, economic and social effect of the adjustment of the current regulations of the Central Bank of Russia is revealed. The authors propose to edit the provisions affecting the implementation of the issuance of prepaid cards by credit organizations, the economic feasibility of the results of the research problem. The novelty lies in an integrated approach to the consideration the prism of legal science, as well as in the new draft legal norm designed to ensure the improvement of the economic and legal mechanism for regulating electronic payment systems. With a sufficiently low level of knowledge of the problem, an array of relevant sources was considered, which determines the comprehensiveness and depth of the problem analysis by the authors. The authors propose a change in the content of the Regulation on the Issue of Payment Cards and on Operations Made with Their Use, approved by the Bank of Russia on 12/24/2004 in terms of performing the procedure for issuing prepaid cards of electronic payment systems. The analysis was carried out using foreign legal sources. The experience of the European Union countries and the United States of America in regulating similar economic mechanisms has been applied. When examining the problem, examples of violations of legislation in the field of electronic payments, indicating the imperfection of the legal aspect of the economic phenomenon under consideration, are given.
