ADMINISTRATIVE AND LEGAL STATUS OF A STUDENT OF THE EDUCATIONAL INSTITUTION OF HIGHER EDUCATION

The article examines a comprehensive study of the elements of the administrative‑legal status of a student of an educational institution of higher education. It is noted that the structure of the administrative‑legal status of a student includes rights, duties, their guarantees and responsibility in the sphere of higher education. Classification of administrative rights in the sphere of education is proposed for their systematization and convenience of consideration. It is indicated that legislatively enshrined measures of social support and stimulating students in the learning process are essentially rights of students in cases prescribed by law, and can be included in the group of administrative rights in the sphere of education. It is necessary to consider that Russia’s participation in the Bologna process expanded list of students’ rights in terms of acquisition of higher education in undergraduate and graduate programs, as well as participation in academic exchange programs. It is necessary to pay attention to fact that rights in the sphere of education are basis of the administrative‑legal status of a student, providing learner with legal opportunities for higher education and subsequently for its implementation in both professional and personal directions. In the article duties of students are identified, the measures of responsibility applied to students for violation of statute of the university, internal regulations and other local regulations are specified. The guarantees of the administrative‑legal status of a student of a higher educational institution, including ways of protecting violated rights and legitimate interests are considered. It is concluded that a comprehensive study of elements of the administrative‑legal status of a student in an educational organization of higher education provides a complete picture of the student’s position in realization of the right to higher education and possible participation in specific legal relations in the sphere of education.
