The article substantiates the conclusion that the principle under study is not declarative, has a sufficiently clear regulatory mechanism of implementation, and is in demand in judicial practice. The greatest impact on the parameters and types of planned construction of a particular property have the documents of urban zoning – the rules of land use and development, dividing the territory of the municipality into the territorial zones, and establishing town‑building regulations for each of them. No less important for the construction is the documentation on the space planning, defining the boundaries of existing and planned elements of the planning structure, the boundaries of the zones of planned placement of capital construction objects, etc. Documents of territorial planning (from the Federal to the municipal level) are devoted to strategic issues of the territory development, and their impact on the activities of a particular developer is indirect. |
