SELF-DETERMINATION OF CRIME: CONCEPT AND FORMS

The article examines the phenomenon of self‑determination of crime, identifies its features, identifies forms of self‑determination of crime and develops its classification. When studying the determinants of crime, special emphasis should be placed on self‑determination of crime in connection with its poor research. To achieve the research goal were used the following methods: analysis, synthesis, induction, deduction. Based on the study, the author distinguishes several approaches to the definition of self‑determination: general scientific, social and criminological. It seems most true to consider the self‑determination of crime as the process of the generation of new antisocial acts by crime. Self‑determination of criminal forms of behavior is carried out through the interdependence of various types of activities that a particular person performs. The forms of self‑determination of crime according to the mechanism of influence exerted can be divided into two main groups: those that have a direct self‑determining effect and those that have an indirect self‑determining effect. The first group should include the commission of auxiliary crimes, an organized crime, recidivism, corruption, professional crime, penitentiary crime. The second group should include latent crime, unsolved crime, shadow justice, a special psychology of society and criminal anti‑culture. According to the level of action, the forms of self‑determination of crime can be divided into self‑determination of certain types of crime (mercenary, violent and other types of crime) and self‑determination of certain crimes (murder, receiving and giving a bribe, organizing an extremist organization and others). The study develops and clarifies the complex and practically significant problem of studying the phenomenon of self‑determination of crime in order to minimize the spread of this phenomenon in society.
