Annotation:

The article discusses some of the most pressing issues in the investigation of criminal cases instituted on the fact of committing crimes of an economic nature. Particular attention is paid to the problems of conducting separate investigative actions in criminal cases of the analyzed category of crimes in accordance with the current legislation of the Russian Federation. Based on the fact that it is criminal procedural activity as an instrument of the law enforcement system that is designed to ensure the economic security of the state, it follows that the criminal procedural law plays a leading role in regulating the investigation of economic crimes and at the same time acts as a “shield” for business entities. Special attention is paid to amendments to the legislation that will help prevent the negative consequences of unfair competition of economic entities in relation to each other. The article also discusses innovations regarding the peculiarities of seizing electronic information carriers and copying information from them during investigative actions, as well as additions to the procedure for recognizing objects and documents as material evidence in criminal cases about economic crimes. In addition, questions are presented regarding such an innovation in the criminal procedure legislation as the right of a suspect and accused, in custody or in conditions of house arrest, to visit a notary public in order to certify the fact of the power of attorney of these persons to represent their interests in business sphere. It also examined other issues related to the problems of criminal procedural legislation in the investigation of economic crimes, which together help to create an understanding of how criminal procedural activity acts as a legal means of economic security of the state.
