TO THE QUESTION OF THE PUBLIC DANGER OF CRIMES IN THE FIELD OF ILLICIT TRAFFIC IN NARCOTIC DRUGS AND PSYCHOTROPIC SUBSTANCES

The article considers the peculiarities of the public danger of crimes in the field of illicit traffic in narcotic drugs and psychotropic substances. Based on the scientific approach regarding the category of “public danger of a crime”, its essence and content, the types of public danger are specified, its individual aspects are revealed. The different types of public danger of a crime — general, precedent, special (simple, progressive) — are investigated. An analysis of the social danger of crimes in the field of illicit traffic in narcotic drugs and psychotropic substances makes it possible to identify their characteristics, which include: the formation of a criminogenic environment, expressed in the commission of grave and especially grave crimes by drug addicts in order to obtain funds for the purchase of drugs; the existence of a close correlation between crimes in the field of illicit traffic in narcotic drugs and psychotropic substances, as the commission of one determines the commission of the other; crimes in the field of illicit traffic in narcotic drugs and psychotropic substances are directed against an indefinite wide range of persons, endangering the health and life of the nation as a whole. The characteristics of the social danger of crimes in the field of illicit traffic in narcotic drugs and psychotropic substances, characterized by signs of progressive social danger, are revealed. An analysis of the public danger of crimes in the field of illicit trafficking in narcotic drugs and psychotropic substances revealed their characteristics, which include the formation of a criminal situation, which is expressed in the commission by drug addicts in order to extract funds for the purchase of drugs serious and especially serious crimes; the close correlation between the crimes of illicit traffic in narcotic drugs and psychotropic substances, due to the fact that the commission of some are determined by others; crimes in the field of illicit traffic in narcotic drugs and psychotropic substances are directed against an indefinite wide range of persons, endangering the health and life of the nation as a whole. The characteristics of the social danger of crimes in the field of illicit traffic in narcotic drugs and psychotropic substances, characterized by signs of progressive social danger, are revealed. The practical importance of dividing the category of public danger of crimes in the field of illicit traffic in narcotic drugs and psychotropic substances into types is due to the fact that the definition and documentation of its parameters allows individualizing the punishment of a particular person who has committed a crime in this area. The question of the imposition by the legislator of sanctions for crimes in the field of illicit traffic in narcotic drugs and psychotropic substances, due to their progressive public danger, is extremely important.
