Currently, various innovative (digital) tools for attracting investments in various spheres of entrepreneurial activity are widely used in the Russian Federation, which make it possible to modify a number of legal relations at the level of various economic spheres. For example, such “tools” include investment platforms, which in recent years have been actively forming their own sector of financing business entities. The main focus in the distribution of such digital tools is, as a rule, on the integration of such tools into new markets and spheres. However, it is also important to ensure the adaptation of long-existing civil law institutions in relation to new digital realities, which will potentially increase the potential for the development of the domestic legal system due to the quantitative or qualitative improvement of such conservative markets. Such markets include, among other things, the sphere of shared-equity construction of apartment buildings, which is one of the most important for solving the housing problem in Russia. The introduction of new forms of expression of classical civil law relations into the Russian economy, which includes utilitarian digital rights, provides grounds for searching for effective levers of integration of these digital entities in markets of this kind. This work is trying to give answer to the question of how appropriate such integration is and whether it is possible in principle under the current legislation. As one of the options for this integration, based on a number of factors that are discussed in the work, is the “packaging” of the requirements under the contract of participation in shared construction in the form of utilitarian digital rights. |
