SOME ASPECTS OF SELF-REGULATION IN RETAIL IN THE RUSSIAN FEDERATION

Annotation:

The article is part of the author’s series of publications on state regulation of trade and is devoted to the problem of self-regulation in retail in Russia. From the beginning of 2000 until 2009, a situation was created in Russia in which retail chains began to expand and form, the industry development strategy had already been approved, but no law regulating trade was adopted. This article examines in whose interests the Trade Law of 2009 was adopted and reveals that after its adoption, the relationship between retailers and suppliers did not undergo major changes, many cases of alleged discrimination were opened in court, most of which were subsequently closed due to the absence of violation. An example of self-regulation of the industry is given in the form of signing the Code of Good Practices, which laid the foundations for open, honest and mutually beneficial relations of retail chains with suppliers and the provisions of which have entered into business practice. At the same time, some issues, such as deferred payment for food products, depending on their expiration dates, are regulated by law. The article draws an analogy with online. The beginning of the process of self-regulation in online commerce can be seen in the signing of the Standards for marketplaces’ interaction with sellers of goods in 2022, which should protect the rights of sellers in terms of liability for transferred goods and changes in the game rules of the platforms. The process is in its initial stage and the marketplaces have not yet changed their approaches to sellers, but over time the situation should improve as it happened in offline retail.
