LEGAL AND STRUCTURAL-FUNCTIONAL APPROACHES TO THE STUDY OF THE CATEGORY OF NATIONAL SECURITY OF THE RUSSIAN FEDERATION

The authors draw attention to the fact that neither at the theoretical nor at the legislative level there is a unity of approaches to understanding such categories as security and national security, somewhere a narrow approach is used to disclose their content, somewhere a wide one, somewhere there is a blend of these definitions, complete or partial. It is noted that direct security activities include forecasting, identification, analysis and assessment of security threats, the development and application of operational and long-term measures to identify, prevent and eliminate security threats, localize and neutralize the consequences of their manifestation, but at the same time, at the level of the law, such an important component as the assessment of the condition is missed. It is further pointed out that the concept of security is often interpreted too broadly, which violates the consistency in understanding and evaluating the ratio of categories such as security and national security, in connection with which, the authors believe, restrictions are needed on the use of the term “security” in relation to objects that do not have sufficient autonomy and independence in political relations and therefore have no real possibility to ensure their own self-preservation, self-maintenance and self-reproduction. According to the authors, the interpretation of the term “security” should contain an indication of the spatial-temporal correlation and the functional sphere of ensuring the sovereign entity — the multinational people of Russia. They also come to the conclusion that the use of the term “security” in relation to subjects who are able to independently ensure their survival will concentrate the forces and means of ensuring their safety both in the scientific and practical spheres.
