Administrative liability is a type of legal liability, covering relations in the field of public administration, ensuring law and order, safety and observing administrative legal norms. This type of liability applies to actions that violate administrative and legal regulations, affecting both the activities of individuals and legal entities, as well as the actions of state authorities, while not reaching the level of criminal offenses. In the legal literature, great attention is paid to the issues of administrative liability. However, the Code of the Russian Federation on Administrative Offenses of 2001 does not provide a normative definition of the term “administrative liability”. Instead, the considered concept is revealed through the characteristics of administrative offenses. In scientific legal literature, there are several approaches to understanding this institution, which allows us to consider it as a multi-meaning phenomenon with various functions and mechanisms of influence. Some authors see administrative liability as a legal bond that arises between the offender and state authorities, which establishes the order of influence on the offender at the time of committing the offense, while others emphasize its preventive and restorative function, which includes the obligation of the offender to admit his guilt, bear the appropriate punishment and realize consequences of their unlawful behavior. The article examines the institution of administrative liability, with an emphasis on its inextricable connection with the concept of “administrative offense”, which serves as the basis for the application of sanctions within the framework of administrative law. In the process of analysis, significant theoretical problems that arise when interpreting this term in legal science are revealed. This made it possible to formulate the author’s definition of administrative liability, which takes into account both traditional approaches and revealed contradictions in the application of this institution in law enforcement practice. |
