THE LEGAL REGIME FOR THE INTRODUCTION OF INTELLIGENT TRANSPORT SYSTEMS

This article examines the features of intelligent transport systems in order to develop proposals for improving their legal regime based on a comparative legal analysis of current European and Russian legislation on the use of intelligent transport systems. The article analyzes European documents in the field of application of intelligent transport systems: Action Plan for the implementation of intelligent transport systems in Europe, Directive 2010/40/EU of the European Parliament and of the Council on the fundamentals of the implementation of intelligent transport systems in the field of road transport and for interaction with other modes of transport, Directive (EU) 2023/2661 amending Directive 2010/40/EU, as well as national strategic documents in the field of transport: the Transport Strategy of the Russian Federation until 2030, the Concept of Ensuring Road Safety Involving Unmanned Vehicles on Public Roads, the Road Safety Strategy in the Russian Federation for 2018—2024. As a result of the research, the author concludes that intelligent transport systems in Russia and Europe are defined exclusively in relation to motor transport, without taking into account the specifics of other transport segments. Thus, the author proposes a normative definition of intelligent transport systems, since the conceptual framework is the basis of any legal regulation. Based on the results of the analysis of national policy documents and foreign legislation in the field of intelligent transport systems, the author concludes that it is advisable to apply an integrated approach to the regulation of intelligent transport systems, including proposals for updating current legislation in the field of transport.
