The article is devoted to the study of the means
of individualization of non-profit organizations (NPOs) in civil
circulation. The relevance of the study is determined by the need
to effectively protect the interests of NPOs and improve their
identification in the market.
Non-profit organizations are actively involved in civil cir-
culation. Like other subjects of civil law relations, NPOs have
properties that individualize them. The legal protection of such
individualizing features is important to protect reputation and
prevent abuse. Means of individualization play an important
role in non-profit organizations, as they allow you to distinguish
one organization from another, help attract attention and build
a reputation. The article analyzes existing research, in partic-
ular, the works of such authors as A. E. Vasilyeva, A. M. Chot-
karaev and others, who emphasize the importance of legal pro-
tection of individualizing features to preserve the reputation of
organizations.
During the study of the means of individualization of
non-profit organizations in civil circulation, key problems were
identified that hinder their effective activities: insufficient legal
protection of NPOs in disputes with commercial structures,
uncertainty of the legal nature of commercial designations and
the lack of registration of these designations. The results of the
study confirm the need to reform legislation in the field of NPO
rights protection, which will ensure their successful functioning
in civil circulation. In conclusion, recommendations are formulated on recog-
nizing the name of an NPO as an independent means of indi-
vidualization, introducing clear rules for the registration of
commercial designations and increasing liability for trademark
infringement. The results of the study are useful for lawyers,
human rights defenders and legislators, as they aim to improve
the legal framework. The article may be of interest to scientific
and educational institutions for use in research activities and
training courses. |
