The Concept of the court reform in the RSFSR was approved by the decree of the RSFSR Supreme Soviet on October 24, 1991. The Concept identified the most significant directions for improving criminal court procedures; and a lot of things outlined in the Concept have been implemented, including the provisions of the Criminal Procedure Code, and other laws. A lot, but not everything and sometimes not in the way it was specified by the Concept. For example, at present there is a small number of cases under the jurisdiction of the jury, the powers of the prosecutor and the head of the investigating unit have been significantly changed, the united investigating body has not been created as it was specified by the Concept, and etc. The author has reviewed the ratio between the provisions of the Concept of Court Reform in the Russian Federation and the provisions of the Criminal Procedure Code on the basis of their analysis, and has made proposals for improvement of the criminal procedure legislation. |
