THE CRIMES OF GAMBLING: PROBLEMS OF QUALIFICATION AND IMPROVEMENT OF LEGISLATION

Federal Law dated 20.07.2011, # 250-FZ introduced article 171.2 into the Criminal Code of Russia that stipulates responsibility for illegal arrangement and (or) implementation of the games of chances. However, the law enforcement authorities have failed to get the anticipated results of the struggle against the publicly dangerous gambling business upon adoption of the stated regulation. The article has provided the analysis of the issue of application of the criminal legislation in the area of counteraction to the illegal gambling business; and has proposed measures for improvement of the current revision of article 171.2 of the RF CC, as well as has justified the necessity of criminalization of the most dangerous activities connected with the games of chances.
