The features of the administrative and legal status of the supervision authorities of special competence in the area of economics have been analyzed in this article. It has been proven that the special powers are defined by the laws and/or regulations or by the regulatory-legal enactments governing the activities of the appropriate supervision authorities. Such special powers have been reviewed; the relevant legislation and its implementation have been analyzed. The number of public services, executive authorities of special competence, has been identified, which perform supervision in various sectors of the economic activity. It has been proven that the legal status of the services is defined by means of provisions regarding their activities, as well as the relevant laws that define the ability of the state control in a particular area of business. The main attention is focused on the analysis of powers (rights and obligations) of the control authorities as the central component of the administrative and legal status. The proposals have been made for improvement of the existing legislation regulating the legal status of regulatory agencies for business entities, namely the Law of Ukraine «On the Basic Principles of the State Supervision (Control) in the sphere of economic activity» to determine the comprehensive list of agencies that have authority over the control of economic entities defining their respective fields of activity. |
