The scientific article presents the study of the issue of the judicial power in classical Islam on the background of the main forms of manifestation of judging in the conditions of early Islamic Arabia. The primary forms of judging are determined, namely, courts of arbitration, the court of the chief administrative officer, their specificity and identity, mutual combination and the role of professional refereeing kaziya in the process of its formation. Accordingly, the just traditions of the Prophet Muhammad (s) and the Rightly-Guided Caliphs are scientifically analyzed; and based on this, the main form of the judicial power development in the era of Islamic classicism are identified. |
