CELLAR PREMISES WITHIN THE COMMON PROPERTY OF THE BLOCK OF FLATS: THEORY AND PRACTICE

In the article, the author explores the principles of formation of common property in the block of flats according to the RF legislation. The author pays special attention to the issue of inclusion of the premises located in the basements of apartment buildings into the common property. The conclusion that availability of equipment designed to service more than one room in the house (technical basement) is crucial for resolution of the issue in the houses where there are privatized apartments. Such premise should be subject to the regime of the common property. Only in the absence of such equipment, the purpose of the premises on the date of privatization of the first apartment in the house shall be significant.
