FEATURES OF LEGAL REGULATION OF THE MINOR’S LABOR IN THE VIDEOCLIPS PLACING ON THE YOUTUBE PLATFORM

Various aspects of the legal status of minors are studied in numerous works of scientists, however, the recent use of child labor when shooting videos for the YouTube platform was not adequately reflected in these studies. This article explores the problems of legal qualifications of children’s labor when filming in videos posted on the YouTube platform. In this regard, the author analyzes the essence of the legal relationship arising between parents and children in the process of shooting that kind of videos. Considering the norms of Russian and international law, the author comes to the conclusion that there are no signs of labor relations in these relations. At the same time, when shooting children in videos for the YouTube platform, organizations for entrepreneurial purposes concluded that it was necessary to comply with the labor legislation of the Russian Federation. In addition, the article discusses the relationship between the YouTube platform, parents and children when posting videos on it with the participation of children. The rules of interaction with the YouTube platform are analyzed, signs are revealed that allow the platform to be attributed to the employer. The author concludes that there are no signs of atypical labor relations in these relations because the YouTube platform does not have signs of an employer. It is proposed that these relations be qualified as civil law, aimed at promoting certain goods or services of advertisers. In conclusion, it is noted that the legislator should adopt appropriate amendments to the legislation of the Russian Federation, which will allow to properly classify and streamline these relations. These changes will allow you to properly protect the rights of children when posting videos with their participation on the YouTube platform and similar platforms.
