SUBSTANTIATION OF THE REGULATORY FRAMEWORK FOR THE INSTALLATION OF ASPHALT CONCRETE PAVEMENTS FOR INTRA-BLOCK (YARD) DRIVEWAYS

The article is devoted to the analysis of regulatory and technical documents, judicial practice and information from open sources in the context of the upcoming termination of a number of acts from June 1, 2024, regulating, in particular, the construction, reconstruction, overhaul and repair of highways, as well as landscaping. The purpose of the research is a comprehensive study of the regulatory legal framework of asphalt concrete pavements of intra-block (yard) driveways in the Russian Federation. The authors pay special attention to the differentiation of the concepts of “highway” and «through passage” used in regulatory legal acts regulating landscaping and road construction. The theoretical basis of the study was an extensive set of documents, a variety of administrative and judicial practice. The features established by the authors (location, purpose, permitted use and other unique characteristics of the object) made it possible, in particular, to reasonably distinguish the intra-block (yard) driveway as an element of landscaping from the public highway. It has been established that the normative and technical basis for the installation of asphalt concrete pavements of intra-block driveways, which are elements of landscaping, are SP 82.13330.2016, including GOST 9128, GOST 31015, while GOST R 58406.1, GOST R 58406.2 can be applied if they are provided for in the design documentation (construction, reconstruction, major repairs) or on the basis of a contract (state or municipal). The application of these regulatory documents is a condition for securing the contract (state or municipal) during repair. The regulatory and technical base for the installation of asphalt concrete pavements of driveways that are public roads is regulated by SP 78.13330.2012, including GOST R 58406.1, GOST R 58406.2.
