The rapid development of information and communication technologies has led not only to the uncontrolled collection
of personal data, but also to large-scale leaks. The illegal dissemination of this data can, among other things, create a threat to a personal safety of the individual. Billions of people around the world
use cloud-based Internet services. As a result of their popularity,
the amount of personal information that is now stored and managed online is steadily increasing. On the one hand, digital technologies make it much easier for all interested parties to exchange
necessary personal data, but on the other hand, they increase the
risk of their exposure to third parties who may misuse them for their
own and, more often than not, unlawful purposes. The number of
cases of unauthorized processing of personal data online and their
unlawful dissemination and use is steadily increasing
Until now, there is no common understanding among scientists, practitioners, and the legislators in the first place, of what
exactly should be classified as personal data and how it relates
to data about a person’s private life. In turn, in the criminal
law, the protection of a person’s privacy is formulated in the
most general form. There are no special criminal law norms to
ensure the inviolability of not only private and family life, but
also personal data located on the Internet, and the legality of
their digital processing. The author concludes that there is an
urgent need to systematize the legislation in this area, as well
as to develop criminal legislation to ensure the protection of
private personal data. |
