The article offers a theoretical justification for the possibility of entrepreneurial activity within the framework of Marxist ideology and the legal paradigm. Based on the consideration of the basic provisions of Marxism, existing scientific ideas in the field of labor law, as well as modern legislation, the definition of labor as a civil right and entrepreneurial activity as an independent exercise of one’s authority is put forward. In addition, attention is drawn to the reason for the considered misconception about the incompatibility of Marxism and entrepreneurship — the combination of entrepreneurial activity and exploitation. It is reflected that the legal formalization and consolidation of exploitation, despite the normative separation of labor law from civil law as an independent branch, remains in its nature a civil law relationship, despite the high level of public law interference. It is indicated that in addition to labor relations, today there is a way of conducting business that is quite consistent with the Marxist view, in which the subject combines the functions of an employee and an owner. It is shown that this type of entrepreneurship fully corresponds to the goals and objectives of Marxism. The result obtained provides an essential definition of entrepreneurial activity in contrast to the modern normative definition, which is an enumeration of individual properties. The proposed definition will make it possible to distinguish between entrepreneurial and other income-generating activities. In the future, this material will be used as the basis for the differentiation of the conceptual apparatus of civil legislation. |
