PREVENTION OF ILLEGAL TRANSFER OF CULTURAL PROPERTY ACROSS THE BORDER

| Annotation: | Culture and society are inextricably linked to each other. Society will not function without culture, and culture without society. The protection and passing of cultural heritage from generation to generation is the primary, most important task of each State. Cultural heritage objects are becoming more and more often the subject of offenses in connection with non-declaration and false declaration, due to non-compliance with prohibitions and restrictions, as well as their concealment from customs control. In course the study, the characteristics of the activities of customs authorities to combat the movement of cultural property in violation of legal requirements were considered. The issues of legal regulation of the concept of cultural values are studied. The authors describe the activities of customs authorities in the exercise of control functions when moving cultural heritage objects across the border of the Eurasian Economic Union. In the course of the study, the authors identified some problematic aspects of the preventive activities of customs authorities, and suggested ways to solve these problems. The article reveals the theoretical aspects of the legal regulation of customs control while transferring cultural values and objects of cultural heritage, analyzes the norms of Russian legislation and the Eurasian Economic Union in this area, materials of law enforcement practice on this issue. This article is an attempt to identify problematic issues in the implementation of customs control by customs authorities in relation to cultural values, cultural objects transferred across the customs border, and possible solutions in this area of legal relations. | ||
