TRANSFORMATION OF ETHICAL AND LEGAL VALUES IN MARRIAGE AND FAMILY RELATIONS IN THE RETROSPECTIVE OF THE RUSSIAN STATE (HISTORICAL AND LEGAL ASPECT)

| Annotation: | Marriage and family relations in Russia today, as at all times, are very significant for the state, since the value of the family in society is quite high. The main basic family values are the value of marriage and family, their legality, the moral foundations of a single family and society as a whole, the upbringing of children, and assistance to disabled family members. Today, the state’s policy is aimed at strengthening these values: state programs are being adopted to support motherhood, fatherhood and childhood, promote fertility, and provide legal and family-moral education to young people. But an important thing in this direction is the appeal to historical legal norms, the origins of these values, the moment of their origin. It is the majority of the processes taking place today that are conditioned by the past of the people and society. In this regard, the authors turn to the texts of the primary sources of family law of Ancient Russia, as well as to the legal acts of the later period of Russia`s statehood. The article analyzes to a greater extent the regulatory framework governing family and legal relations in different historical periods, the authors turn to primary sources and reprints of ancient publications for a holistic view of the family and legal aspects of church and state management of society. In addition, the article presents the positions of scientists on a particular issue in the field of analysis of family and legal relations in different historical periods. As a result, the authors’ point of view has been comprehensively developed during the interpretation of normative legal and historical acts, the positions of scientists in this field and the analysis of existing law enforcement practice. | ||
