PROTECTION OF PERSONAL INFORMATION OF A RELIGIOUS NATURE IN THE DIGITAL SPACE: COMPLEX LEGAL REGULATION AND PECULIARITIES OF SUCH PROTECTION

The article deals with regulation of protection of personal information of religious nature in the digital environment. It is concluded that personal information of religious nature as a multicomponent subject of legal relations is regulated by different branches of law, which are internally linked. The peculiarity of the complexity of the institute stems from its parent legal branch information law. The signs of complex regulation in relation to the institute of personal information of religious nature, namely the signs of integration, systematicity, objectivity, the presence of a specific system of concepts and categories, the need for special sources of law, polystructure and efficiency are considered. While considering these criteria, it was determined that there is a need for the formation of new approaches to the legal regulation of this phenomenon, which will meet the requirements of modern legal and social reality. Amendments were proposed to the Federal Law of September 25, 1997 No. 125-FZ “On Freedom of Conscience and Religious Associations”, to the Federal Law of July 27, 2006 No. 152-FZ “On Personal Data” and to the Federal Law of July 27, 2006 No. 149-FZ “On Information, Information Technologies and Information Protection”. There is also a need to take into account the identifying set of data, which consists of information components not directly related to the identified person, but with the aggregate of such components and their systematization can acquire an identifying character within the framework of the information and digital environment.
