UNFAIR USE OF NEIGHBORS’ RIGHT AS A VIOLATION OF THE CONSTITUTIONAL RIGHT TO HOUSING

The constitutional right to housing in its semantics represents not only a socially preventive measure to ensure such conditions for the existence and development of Russian society and the state, in which the well-known “housing issue” is no longer a “stumbling block” for most citizens, but also the “pinnacle of the complex legal structure” of this right, which defines the main directions of internal policy of the Russian state in matters of social security, housing construction, preferential loans to the population in the context of constitutionally defined “undertakings”. However, like any right, the right to housing has the factors of its diminution, violation and other neglect. From the whole variety of law enforcement practice, the positions of Higher Courts, the positions of constitutional scholars, media materials and other sources, the author suggests a study on such a specific form of violation of the constitutional right to housing as unfair use of neighbors` right to an apartment in an apartment building, to a land plot intended for individual housing construction, and to a room in a communal apartment. The article offers a comprehensive legal, technical, constitutional and legal analysis of various forms of unfair use of neighbors in the context of expressing such forms of unconstitutional actions or omissions in essence violating the right to housing in the context of its primary constitutionally defined role as one of the most important social rights of citizens. In conducting this research, the author used the Constitution of the Russian Federation, acts of the legal system of the Russian Federation at various levels, acts of the application of law, scientific legal and legal literature.
