Annotation:

This article presents a comprehensive study of the legal status of international organizations in contemporary international law. The author traces the evolution of scientific concepts of international legal personality of organizations from complete denial of their independent status to recognition as full-fledged subjects of international law. Based on the analysis of advisory opinions of the International Court of Justice and decisions of other international judicial bodies, the paper explores key theoretical approaches to substantiating the international legal personality of organizations: the «will theory», the «objective theory», and the concept of «presumed legal personality». Special attention is paid to the legal nature and boundaries of competence of international organizations through the prism of doctrines of attributed, implied, and inherent powers. The author identifies the limitations of each of these doctrines and substantiates the necessity of their integrated application. The final part of the research examines current trends in determining the legal status of international organizations, characterized by a departure from the rigid opposition of competences of states and international organizations towards a more flexible functional approach, which reflects the general process of transformation of the modern system of international relations. The study reveals that the transition from a strict delineation of powers to understanding them as overlapping spheres of competence of various subjects of international law is becoming increasingly pronounced, which requires a revision of traditional theoretical constructions and the development of a balanced approach that considers both the needs of international cooperation and respect for the sovereign rights of states.
