TYPICAL COURT SITUATIONS AND ALGORITHMS OF THE PUBLIC PROSECUTOR’S ACTIONS IN CASES OF ILLEGAL ENTREPRENEURSHIP

The article examines the theoretical and practical aspects of maintaining public prosecution in criminal cases of illegal entrepreneurship. The paper provides a comprehensive analysis of typical judicial situations that arise when considering cases in this category, and develops tactical recommendations for public prosecutors. The classification of judicial situations according to three main criteria is proposed: the safety of the evidence base, the defendant’s position regarding the charges and the degree of opposition from the defense. For each selected type of situation, an algorithm of actions of the public prosecutor has been developed, including methodological recommendations on working with evidence, tactics of interrogation of participants in the process and interaction with law enforcement agencies. Special attention is paid to problematic aspects of maintaining public prosecution in the face of opposition from the defense, including situations of providing new evidence. The issues of tactical planning of the activities of the public prose-cutor during the judicial investigation, the specifics of the presentation of certain types of evidence are considered in detail. The practical significance of the research lies in the development of an integrated approach to maintaining public prosecution aimed at improving the effectiveness of criminal prosecution in criminal cases of illegal entrepreneurship. The recommendations proposed by the author take into account current trends in judicial practice and current problems of law enforcement. The materials of the article can be used both in the practical activities of prosecutors and in the educational process during the training of lawyers. The study makes a significant contribution to the development of methods for maintaining public prosecution for economic crimes and contributes to the formation of uniform judicial practice in cases of this category.
