THE ISSUES OF QUALIFICATIONS ILLEGAL DISCHARGE FROM THE CRIMINAL RESPONSIBILITY

In this article an author examines the issues of qualification of crimes specified in Clause 300 of the RF Criminal Code. The priority issues are such as the essence of discharge from the criminal responsibility; when such discharge is considered illegal; and whether all cases of illegal discharge are covered by Clause 300 of the RF Criminal Code. The legal experience, including the experience of the foreign countries, has been analyzed in the article. Ultimately, the author has come to the conclusion that analysis and the use of theoretical and practical experience in the said area is required for the obtaining the positive results.
