TO THE QUESTION OF CONCEPT AND CONTENT OF THE PRINCIPLE OF ACCOUNTING OF VALUE OF THE LAND AS THE BASES OF LIFE AND ACTIVITY OF THE PERSON

The principle of the land legislation on accounting of «the land values as the bases of life and activity of the person» results from more fundamental constitutional norm that «the land and other natural resources are used and protected in Russia as the basis of life and activity of the people living in the respective territory» and is quite consistently implemented in the land legislation. At the same time, in the scientific doctrine and the legislation there are unresolved issues of recognition of the land and other natural objects as the «property of the people», as well as terminological collisions in the LC of the Russian Federation and the Civil Code of the Russian Federation still remain that are connected with fixing in the Codes of the possibility of alienation in the property of the land as a natural resource rather than an individualized real estate object.
