DISCUSSION OF THE SUBJECT OF THE ECOLOGICAL LAW IN RUSSIA, BELARUS AND OTHER CIS COUNTRIES: COMPARATIVE AND LEGAL ASPECT

The article examines modern debatable questions of the subject of the ecological law on the basis of the analysis of scientific positions of the scientists from Russia, Belarus and some other CIS countries. It is proved that the existing both «narrow» and «broad» approaches to understanding of the subject of the ecological law have their pluses and minuses. The broad approach contributes to better showing dynamics of interaction of the measures for rational use and protection of environment as a whole, as well as its individual components; the narrow approach emphasises on the measures for preservation and restoration of the environment. Adhering to the narrow approach to understanding of the subject of the ecological law, the author proposes to distinguish three groups of public relations constituting the subject of the ecological law as a branch of the law.
