THE OPPORTUNISTIC BEHAVIOR OF AGENTS AND PRINCIPALS OF MEDICAL INSTITUTIONS AND ITS LOCALIZATION BY USING EFFECTIVE CONTRACT

Annotation:

The article analyzes the opportunistic behavior of agents (doctors and other medical personnel) and principals (employers) on the example of medical institutions. Opportunistic behavior is considered within the framework of transaction costs theory. Thus the employment contract analyzed in article is considered in the form of the effective contract. The author defines the concept of «effective contract». The specificity of labor relations in health institutions is examined drawing attention to the basic premise of opportunistic behavior in medical environment: forced by the state, the so-called leveling part of labors stimulation; mismatch of goals (interests) of the employer (Chief Medical Officer) and the employee (doctor and other medical personnel); specificity of existing assets (knowledge, experience, skills of highly qualified specialists) and others. The article accumulated types of transaction costs, one of which is the opportunistic behavior of agents and principals. Transaction costs include any loss arising due to the inefficiencies of cooperative solutions, plans, contracts, and created structures, ineffective responses to changed conditions, ineffective protection agreements. The study compared the levels of transaction costs caused by opportunistic behavior under the normal employment contract and an effective contract. The scheme of construction of the system of stimulation of work of medical workers on the basis of the effective contract is resulted. The main goal — to improve the quality of health care for the population — is achieved in this case through the purpose of the proposed methodology: the maximum reduction in opportunistic behavior of workers and employers. Achievements of the established standards of loading and professional requirements to the worker are estimated by the set of criteria of intensity, quality and complexity of work that, according to understanding of the authors of the article, as much as possible reduces opportunism of behavior of both the employer, and the worker.
