LEGAL ANALYSIS OF THEORETICAL APPROACHES TO THE DEFINITION OF NOTARY SYSTEM AND ITS COMPOSITION

The article examines the issues related to the definition of the term notary, as well as the range of persons included in its composition. The paper analyzes various definitions of the notary, as well as the provisions of the current legislation of the Russian Federation on the notary. The legal status of the notary engaged in private practice is investigated. In the framework of the research of the competence of notaries in the article, the classification of notarial actions by their areas of application is considered. The author also analyzed various approaches to the definition of the list of persons included in the notarial system, in which the powers of individual bodies and officials in the notarial system are studied. As a result of the analysis, the author reveals contradictions between different definitions of the term notary and the provisions of the current legislation of the Russian Federation on the competence and composition of the notarial bodies. Based on the results of the study, the author proposes a clarification of the term notary.
