THE PROBLEM OF METHODOLOGY AND RESEARCH METHODS OF HUMAN RIGHTS PROTECTION (THE END OF XX — BEGINNING OF XXI CENTURY)

The article reviews the contemporary issues of the methodology and research methods of human rights protection in the Russian science of law. The author argues that it is necessary to pursue juridical research which supposes comprehension of human rights theory as a whole knowledge system in the science of law. The development of the term «law of human rights» in modern law is investigated. The author analyzes the possibility to define the differences between the concepts of «human being» and «personality» in merely law-terms. It is concluded that an individual is a solitary representative of the human race, he is a subject of law being able in this capacity to play different roles: of a human being, of a personality, of a citizen, and of others (special legal statuses).
