GENESIS OF DEFINITION OF THE CRIME TRACES AND PARADIGM OF CONTEMPORARY APPROACHES

Annotation:

The article presents provisions on formation of knowledge about the concept of traces, philosophical and terminological foundations of modern definition. From the totality of all sorts of the circumstances, the theory of traces acquired the importance in the science of criminology, the result of which was the appearance in the legal literature of many essays about this subject. These are the classical postulates, which being currently applied, when we observe the whole bunch of researches of traces of different kinds: smell, genetic, biological, thermal, computer, digital technologies, traces of sound and many, many others, require new developments in the theoretical conceptual component. The content of traces, in our opinion, includes objects of existing reality (material bodies and physical fields), altered phenomena or events that occurred because of movement, processes and actions. The designation of the concept of traces is impossible without the use of philosophical theories and categories, not only reflection, but also being, existing reality, movement, and many others. Philosophical and some other terms, as a certain set, constituting the basis of the researched concept can be grouped in a certain way as generalized parts of the whole. Currently, the nature and content of the traces of events related to crimes cannot be determined without the theory of energy conservation, the theory of relativity, the theory of information and some other scientific knowledge. Modern paradigms are supposed to consider such new positions when determining the concept of traces. In particular, the essence of material objects is not a unit of substance, but energy; the world is not made up of atoms, but of different connections and relationships; the world is united as a self-regulating integrity; truth is diverse and consists in dispassionateness of the study; objectivity is not related to objectivity, is not opposed to subjectivity.
