The legal experiment carried out by the Ministry of Labor of the Russian Federation on the introduction of electronic personnel document management shows the close attention of the legislator and law enforcement officer not only to the optimization of the work of the personnel department, but also to the digitalization of the entire labor process. The prospects for this experiment are optimistic; they allow us to hope for an almost complete exclusion of paper from the relationship between the employee and the employer, which will undoubtedly increase the degree of efficiency in protecting the labor rights of workers and employers. The author of this article aims to study the possibilities for protecting labor rights in the electronic form of document management. The method of legal analysis and the formal legal method are used in the study of this problem. The main conclusion is that the use of electronic document management will have a positive impact on the efficiency of labor rights protection. The initial introduction of electronic document management is unlikely to achieve all of its goals — the introduction of an electronic form of an employment contract, optimization of the employer’s work, and an increase in the level of protection of labor rights. However, in the future, when the personnel information contained on all digital platforms is synchronized, we assume that the effectiveness of the protection of labor rights will significantly increase and will minimize the risks of electronic errors. An analysis of the proposed changes to the current legislation showed the need to provide the employer with the exclusive right to decide the issue of maintaining personnel workflow in electronic form. Its use by employers will help to reduce the need for technical labor of personnel services, which takes up a huge amount of working time, and to activate their direct functions: drawing up mandatory and optional local regulations, preparing documents for the selection of personnel, etc. |
