SPECIFIC FEATURES OF THE CRIMINOLOGICAL CHARACTERISTIC OF CRIMES AGAINST FREEDOM, HONOR AND DIGNITY

Human rights and freedoms at the current stage of state-legal development are the naturally legal and moral foundation of the entire system of human rights and the further development of a state governed by the rule of law and civil society. The protection of human rights, being a constitutional and international legal obligation of our state, is enshrined in Chapter 2 of the Constitution of the Russian Federation. The fact that a special Chapter 17 of the Criminal Code of the Russian Federation is dedicated to criminal law protection against criminal encroachment on the freedom, honor and dignity of the individual indicates the increased attention of the state to this issue. However, the guarantee of the protection of human rights and freedoms cannot be predetermined by the criminal law alone. Both domestic and foreign criminal law science traditionally articulate a general concept of this group of crimes and provide criminal and criminological characteristics of their individual elements. At the same time, the general quantitative and qualitative measures of crimes against freedom, honor and dignity of the person have not yet been studied comprehensively. This article reviews the main trends in this type of crime over the period from 2017 to 2022 and draws the conclusion that although the crimes under Chapter 17 of the Criminal Code are described by a small share in the overall structure of recorded crime, their public danger and the fact that such crimes as kidnapping, for example, are committed mainly in a group predetermines the need for further and more profound study of the criminological nature of this type of crime, as well as early prevention to avert the offences concerned.
