This article presents a comprehensive analysis of the content and significance of the discourse approach in the professional training of specialists for the judicial system. The relevance of the study is justified by the necessity to search for interdisciplinary and innovative means in the methodology of modern education that satisfy the competence-based guidelines in the structure of the main professional educational programs, as well as the state and society social demands for the education system. It has been determined that the finalized competence of specialists for the judicial system should include several cognitive-discursive skills, comprising the ability to reveal the deeper meaning of phenomena and processes inherent in the legal field. In this regard, the advisability of using discourse analysis as a teaching method in the preparation of future judicial personnel is justified by the fact that with its help it is possible to understand the contextual (situational) subtext, and therefore go beyond the narrow concept of law as a set of legislative norms. To confirm the hypothesis about the applicability of discourse analysis in the professional training of specialists for the judicial system, the authors examine the concepts of discourse, professional discourse, discourse analysis, and their relationship. The study also determined the properties of legal (judicial) discourse: institutionality, performativity, argumentativeness, evidentiality, intertextuality. These concepts and properties are analyzed in the context of judgments of philosophical, philological, legal and pedagogical theory. To achieve specific results, the authors have drawn up a plan for discourse analysis of a judicial decision as a learning task. The final part of the study notes that dialectical analysis is a part of the current standard of highly qualified work in the cycle of judicial tasks and meets the dynamics of the development of modern legal relations, as well as the challenges of the profession. |
