ACTUAL PROBLEMS OF IMPROVING THE CRIMINAL CODE OF THE REPUBLIC OF BELARUS IN THE CONDITIONS OF ECONOMIC RELATIONS TRANSFORMATION

Today it is possible to state the presence of actively developing market relations, as well as the introduction of information and communication technologies in all spheres of the economy. The processes occurring in economic activity are objectively reflected in the law, requiring not only the actualization of regulatory norms, but also the improvement of responsibility in this area. The article analyzes the essence of economic relations in modern conditions, reveals that they are characterized by equality of participants of civil turnover, who enter economic relations on the production of tangible and intangible goods. The approach proposed in this article allows unambiguously distinguishing economic crimes from other socially dangerous acts related to the economy. In this regard, the author critically assesses the existing structure of the Special Part of the Criminal Code of the Republic of Belarus, on the basis of which it is proposed to allocate economic crimes in a separate chapter “Crimes against the order of production of economic goods”. In addition, an important part of modern digital economy is the use of blockchain technologies, cryptocurrencies, e.g. within the activities of specialized businesses such as crypto exchanges. This article traces the transformation of economic relations in the conditions of digitalization, reveals the emergence of new socially dangerous acts associated with the development of the digital economy, including illegal mining, manipulation of token price. On the basis of our analysis we have developed and proposed ways to improve the Criminal Code of the Republic of Belarus in terms of establishing responsibility for economic socially dangerous acts, which have a digital form. The article also proposes some measures to prevent the relevant socially dangerous acts.
