THE ARCTIC ZONE OF RUSSIA IN THE PROJECTION OF THE LEGAL AND REGULATORY MECHANISMS

The present article is devoted to the disclosure of the current state of the legal and regulatory mechanism covering the issues of the Russian state’s activity in the Arctic. On the basis of analysis, clustering, description, comparative analysis of categories, formal-legal method, as well as literal and logical interpretation of legal norms the essence of spatial-territorial regulation of the Arctic is outlined, the essence of strategic regulation of the Arctic zone on the national political level is comprehended, the Arctic regulation of operational and managerial nature is analyzed, the main directions of perspective and stimulating regulation are revealed, the current state of legal regulation is assessed. It is concluded that the legal-regulatory mechanism for the development of the Russian segment of the Arctic zone is sufficiently developed and extensive, which is reflected in the existence of a well-developed institutional foundation and a clear plan for the implementation of Arctic policy, as well as in the functioning of incentive development measures such as the institution of residency in the Arctic zone and the Arctic mortgage. Such gaps in the legal regulation of public relations in terms of the development of the Arctic zone, as the lack of indication of the Arctic problem in the Decree of the President of the Russian Federation from May 7, 2024 No. 309 ‘On the national development goals of the Russian Federation for the period up to 2030 and in the perspective up to 2036’, as well as the actual and legal exclusion of the public council of the Arctic zone from the implementation of management powers are indicated. It is noted that the identified legal gaps can be eliminated by including in the above Decree of the President of the Russian Federation provisions on the strategic importance of the development of the Arctic zone and establishing a list of subjects of jurisdiction, which require favorable opinions of the public council of the Arctic zone with the introduction of appropriate amendments to the legislation
