The purpose of the article is a theoretical and practical understanding of the process of civil law modeling of the design of digital (virtual) assets using the example of the Russian Federation and the Republic of Azerbaijan. The article analyzes the concepts and elements of legal regulation models in the doctrine of civil law. The research objectives are outlined, including the analysis of concepts, the formation of model elements, and the study of the possibilities of using the model. As a result of the study, an approximate model of legal regulation of the digital (virtual) assets circulation was developed, a comparative analysis of which shows the differences between the Russian and Azerbaijani approaches. This model is the basis for future research regarding the formation of legal regulation of the circulation of digital (virtual) assets. Objects of relations, subject composition, and methods of regulation, conflict of laws regulation and civil law protection of rights in both countries have their own characteristics. For example, in the Russian Federation, digital assets are divided into three groups, while in Azerbaijan; virtual assets are understood as digital expressions of value, excluding certain categories of assets. The need to unify approaches to the legal regulation of digital assets is justified to facilitate international cooperation and reduce legal conflicts. The article proposes a model of legal regulation of the digital assets circulation in the compared countries, which can become the basis for the exchange of experience and the development of more effective solutions in the field of digital law and finance. The scientific novelty of the research lies in developing a legal model of digital assets circulations, which can contribute to the development of modern legislation in this area. |
