LEGAL REGULATION OF THE LIVESTOCK BREEDING: PROBLEMS OF TERMINOLOGY

Article attempts to analyze the current legislation in the field of livestock breeding in Russia, in particular the concept of a breeding animal. A special feature of the current period in the development of legislation on livestock breeding is that it is a transitional one; a system of regulatory legal acts is not yet adapted to market relations, and a unified and consistent system of terms and definitions is absent. Also, to date, many aspects of the legal regulation of agriculture in general have been theoretically developed, but there are no works aimed at a comprehensive detailed study of legislation on livestock breeding. In preparing this article, logical and comparative legal research methods were used, in particular, the analysis of the current legal definition of the concept of a breeding animal was carried out. The article examines the peculiarities of livestock breeding and the importance of regulating this sphere of public relations by legal means, including the importance of reforming the concept of abreeding animal. The importance of breeding work to ensure food security is noted. The study analyzes similar definitions in other countries: the European Union, the Republic of Kazakhstan, the Republic of Belarus, and the People’s Republic of China. The definitions of a breeding animal of these states, their differences from the Russian one, the shortcomings of the current version of the specified concept in Russia and the possibilities for its reform are noted. The issues of breeding value, the need to determine it in breeding work, the importance of establishing requirements for the level of breeding value of animals are considered. The author proposes a new definition of a breeding animal, which establishes requirements for the breeding value (level of genetic potential) of breeding animals.
