| Annotation: |
In the article, the authors trace the evolution
of the concept of a digital platform in Russian legislation as
a basic element of the platform economy. The comparative
approach used by the authors allows identifying different interpretations
of the concept of a digital platform in Russia and
abroad, as well as the existence of a rather lengthy discussion on this issue among Russian researchers of this issue. The article
examines how the change in legal interpretations of the concept
of a digital platform reflects not only the development
and diversity of digital ecosystems and shapes legal regulation
in the Russian Federation, but also shows how the government’s
approaches to the concept of a digital platform have changed.
The authors analyze the changing approaches to the normative
consolidation of the concept as a platform for the realization
of the rights, duties and legal responsibility of its participants.
Currently, digital platforms are used not only by business entities,
but also by the state as a whole, represented by its bodies.
The authors note that the existing legal structures do not take
into account the new digital reality or use different criteria to
designate the concept of a digital platform. Proper legal regulation
of digital platforms will help protect the interests
of both suppliers of goods, services, consumers, and the state.
The authors believe that regulations in this area do not allow
determining the directions of development of the legal regulation
of the problem, do not take into account that platforms need to be
classified depending on the conditions of digitalization of business
processes and the purpose of the platform, but reveal conceptual
contradictions in the evolution of approaches of the legislator
and the government to understanding the phenomenon
of digital platforms. And these contradictions are very significant. |
