Activity in the educational sphere is generally governed by the private, as well as the public sector of law, where each one establishes its own characteristics and specifics of educational process. Neither legal system nor civil doctrine allow for uniform definition of educational process or clearly defines its place in the market system. The article analyses specifics of application of various jurisdiction toward sphere of education, and provides support for an argument why education is never “for profit” activity, even when it is a tuition based. Since there in no legal framework to define educational process, the author suggests its own definition that contains the basic characteristics. |
