LOSS OF THE MILITARY PROPERTY: ISSUES OF QUALIFICATION AND IMPROVEMENT OF THE CRIMINAL LAW

The article has analyzed the indices of such criminal as the loss of military property; the examples of qualification of the actions in compliance with article 348 of the RF Criminal Code have been provided. In the process of investigation the author has come to the conclusion that the imperfection of the criminallegal norm does not allow differentiating the responsibility for the said crime depending of the degree of the public danger of the committed action, namely of the extent of the damage, as well as the specification of the article title is required as it does not comply with the content and purposes of inclusion of the said norm into the criminal law. Due to this fact it is proposed to include the appropriate revisions into the Сriminal Сode.
