| Annotation: | The article is devoted to the analysis of the legal regulation of ownership of property of unit investment trusts from the point of view of the foundations of the continental legal system. In the course of the study, the author examines the types of property that is included in the composition of the unit investment trust from the point of view of the possibility of the accrual of the right of ownership of such property (cashless funds, paperless securities, real estate) and the content of such ownership. The article reveals that such ownership rights of shareholders to the property of a unit investment trust is not provided with absolute legal means of protection. As a result, offers are formulated to address the identified defects of legal regulation in this area. |
