SOME PROBLEMS OF REGULATION OF CONDITIONAL AGREEMENTS IN THE RUSSIAN CIVIL LAW

This article considers the institution of conditional agreements, its essence, features and problems of legal regulation in the Russian Civil law and in the Civil law of foreign countries. The author argues impermissibility of nullity of contract, because of the influence of one of the contractual parties on happening of the condition of the contract; the author detects an insufficiency of classification of condition in the Russian Civil Code for development complete doctrine on conditional agreements and for simplification of judicial practice on this issue; the author analyses the latest changes in Russian Civil Law referred to conditional agreement, including correlation between the articles 157 and 327.1 of the Civil code of the Russian Federation.
